Atome Software is committed to protecting your personal data in accordance with the European General Data Protection Regulation ("GDPR") and the French Data Protection Act No. 78-17 as amended.
This policy informs you about the Personal Data processing carried out in connection with the use of the Atome Software Solution (hereinafter the "Solution"), our commitments, and your rights.
Definitions
- "Personal Data" or "Data" means any information that directly or indirectly identifies a natural person (e.g., name, first name, phone number, date of birth, address...).
- "Data Controller" means the natural or legal person who, alone or jointly with others, determines the purposes and means of processing.
- "Data Subject" means any natural person whose Personal Data is collected and processed via the Solution.

For Personal Data processed on behalf of the Client in the Solution (e.g., content, imported data, entered data), the client who has subscribed to use the Solution is the Data Controller and Atome Software acts as a processor.
For certain processing related to the operation of the Solution (e.g., administrative management, billing, security, support), Atome Software acts as Data Controller. This privacy policy applies in this second case.
How Is Your Data Used?
When you use the Solution, we process your Data under the following conditions and for the following purposes:

Who Are the Recipients of Your Data?
In the context of processing your Data, Atome Software may grant access to your Data to the following persons:
- authorized Atome Software personnel responsible for processing your Data as part of their duties;
- our technical service providers (hosting, maintenance, security, data analysis) who act as processors and on our documented instructions;
- providers of third-party solutions that you choose to connect to our Solution, only for data necessary for the integration;
- judicial or administrative authorities and authorized third parties who may obtain Data communication under a legislative or regulatory provision;
- in the event of a merger, acquisition of our activities or assets, or other similar event, to a potential or actual buyer of our activities or assets with whom we have a contractual relationship.
What Are Your Rights?
In accordance with the French Data Protection Act of January 6, 1978, as amended, you have the following rights:
- Right of access: Obtain a copy of your Data and information on how we process it.
- Right of rectification: Request the rectification of your Data if it is inaccurate or incomplete.
- Right to erasure: Request the deletion of your Data when there is no longer a reason to process it, if you withdraw your consent, if the processing is unlawful, or to comply with a legal obligation.
- Right to restriction of processing: Request that the use of your Data be frozen in certain circumstances.
- Right to object: Object to the processing of your Data based on our legitimate interests.
- Right to withdraw consent: Withdraw your consent at any time if you had given it.
- Right to data portability: Receive a copy of your Data in a structured, machine-readable format.
- Post-mortem directives: Give directives on the fate of your Data after your death.
- Right to human intervention: Request the intervention of a human person to review a fully automated decision.

We will respond to any request received from you within one month from the date of the request.
How Long Is Your Personal Data Retained?
Data is retained for a period adapted to the purposes of the processing and in accordance with applicable legislation and regulations.
In this context, Data is retained as long as the company to which your account is attached has a contract with Atome Software.
In the event that the contract with this Atome Software client company ends, your Data is permanently deleted within 30 days, unless this Data must be retained for evidentiary purposes or unless legal or regulatory retention obligations apply to Atome Software.
Data Security
We have implemented adequate technical and organizational security measures in accordance with industry standards to preserve the security, integrity, and confidentiality of your Data and to prevent your Data from being rendered accessible, altered, disclosed, or destroyed in an unauthorized manner.
All information you provide to us is stored on secure servers, or those of our service providers, within the European Union 🇪🇺. Data is encrypted in transit (via TLS 1.2 or higher) and at rest (via AES-256 or equivalent).
Use of the AI Conversational Agent
Interactions with our AI conversational agent are processed to provide relevant responses in the context of your use of the Solution. This data, including questions asked and associated context, is processed confidentially. It is not used to train or improve the artificial intelligence models of our providers or our own models, unless we obtain your explicit and prior consent for such use.
Modification of the Privacy Policy
We reserve the right to modify this privacy policy.
In the event of a substantial modification affecting your rights, we will take the necessary steps to inform you and will display the updated privacy policy on our site and our Solution. We invite you to check the last update date at the beginning of this document.
